The case against Jessica Seinfield the wife of Jerry Seinfield has been thrown out by a judge.
The copyright suit filed by author Missy Chase Lapine agasinst Jessica was deemed to have no merit.
Records indicate that Ms. Lapine had tried twice submitting her book proposal about sneaking healthy foods into kids meals, only to have it rejected by HarperCollins both times.
Strangely 5 months later, in October 2007, HarperCollins published Ms. Seinfields novel, “Deceptively Delicious : Simple Secrets to Get Your Kids Eating Good Food”.
Although the judge did find similarities in Seinfield’s and Lapine’s books, she concluded that no reasonable evidence or facts can conclude that they have the same aesthetic appeal.
Ms. Lapine’s lawyer, Howard Miller, said he was considering whether to appeal the judge’s ruling on the copyright claim. Ms. Lapine will continue to pursue a related claim against Mr. Seinfeld, Jessica’s husband, whom Ms. Lapine sued for defamation after he made fun of her on “The Late Show With David Letterman,” her lawyer said.
